Court gives judgement on Anti-Homosexuality Act 2023
The Constitutional Court has declined to nullify the Anti-Homosexuality Act 2023 saying the Act does not violate the right to practice business and profession.
The five-member court justices led by the Deputy Chief Justice, Richard Buteera in their judgement said they do not find the Anti-Homosexuality Act to infringe on the right to privacy since it does not allow unlawful entry to premises by law enforcement agencies. Court noted that the evidence on record is the Anti-Homosexuality Act was enacted against the backdrop of the recruitment of children into the practice of homosexuality.
However, journalist Andrew Mwenda reacted on this judgement saying he was disappointed with the constitutional court noting that this Act violates fundamental rights including freedom from discrimination and the right to privacy. He confirmed that he will go to Supreme Court to appeal.
Last year, President Yoweri Museveni assented to the Anti-Homosexuality Act, 2023 and this law was initially passed by Parliament on 22 March 2023, having been introduced as Private Members Bill by the Bugiri Municipality Member of Parliament, Hon. Asuman Basalirwa.
